The Devonshire Arms Hotel – Terms and Conditions

Bedroom reservations

At the time of booking, a non-refundable and non-transferable deposit is required for all rooms, with final balances payable on departure. This is stated on the terms and conditions of the individual offers. No discount shall be offered to children under the age of 15 occupying their bedrooms. Offers may not be used in conjunction with each other, and if conditions are not fully met, then the standard room rate shall apply. A 5% service levy is added to all bills upon checkout, 100% of this going to staff.

Bedroom cancellations

Cancellations must be received in writing. If you have paid a deposit, this will not be refunded in the case of a cancellation. Reservations cancelled within 48 hours of 15:00 for the date of arrival shall be charged the full amount of the stay. We highly recommend that your own travel/holiday insurance is in place at the time of booking. In the case of a no-show, you will be charged the full amount of the stay unless you can provide a cancellation reference number. Group cancellations – Please see contract.

Service levy

A 5% service levy is charged to all accounts before departure for distribution in its entirety (after the deduction of V.A.T) to all staff members on an equal basis. This is a contractual term alongside other terms and conditions of booking.

A 10% service levy is added to all non-resident dining which is distributed directly to staff.

Why do we do this? Conceived in 2007 and operated successfully on behalf of the staff ever since the service levy scheme gives our employees a stake in the performance of the Company. Service levy is directly linked to sales performance and provides an incentive to staff to provide excellent service, over and above the norm, one might already expect within a service industry. Furthermore, this additional incentive assists the Company in attracting potential employees when recruiting and retaining staff.

After the deduction of Vat to the Inland Revenue, the whole amount is distributed to staff without any administration deduction other than PAYE and National Insurance in the normal manner.

Service Levy is not used to ‘top-up’ wage remuneration to legal levels; this is prohibited by law. The Company pays at least above national minimum and living wage rates of pay as a matter of policy. Service Levy thus becomes additional pay to our employees over and above that which the Company considers to already be better than the norm pay rates when compared with our industry sector and thereby rewards staff with pay well above competitor pay rates for comparative jobs.

Why not simply pay even more to our staff? Service Levy is not an overhead cost to the Company and thus falls outside potential ‘wage control’ measures which Companies often have to take in response to fluctuating economic fortunes.

We feel the scheme removes the potentially embarrassing dilemma for the customer of ‘do I tip or not’ or ‘is service included or not’. Should you feel you would like to offer more, then that is perfectly acceptable. Equally, we would be keen to hear your feedback on any suggestions you may have concerning the service you have received.

Arrival/Occupation

Travel cots can be provided and will be placed within the parent/guardians room. Following the no-smoking legislation, The Devonshire Arms Hotel is a smoke-free premises and smoking is not permitted. Smoking in a room will incur an additional cleaning charge to render the room smoke free again.

Description

Whilst Estate Escapes makes every effort to ensure the accuracy of the property descriptions they are inevitably subjective and are for guidance only due to the unique identity of each room. Whilst The Devonshire Arms Hotel has taken all reasonable steps to ensure that the information contained in its brochures, websites, leaflets, advertisements and any other form of promotional material is accurate, The Devonshire Arms Hotel reserves the right to alter, substitute or withdraw any service, facility or amenity.

Liability

Estate Escapes will not be liable for the death or injury of any persons attending any function or for any losses, claims, demands, actions, proceedings, damages, costs or expenses or other liabilities by the Client in the exercise of the rights granted by the booking except where such death, injury or loss is due to the Hotel’s negligence.

Corkage

We do not permit any corkage within The Devonshire Arms Hotel. The Client or guests may bring no wines, spirits or food into the hotel for consumption on the premises.

Loss or damage

The Client is responsible to the Hotel for any loss or damage caused to the Hotel by any act or neglect of the Client, subcontractor, employee or guests of the Client and shall pay the amount required to make good this damage. The Hotel is not responsible for any loss or damage to the Client or their guest’s property. Should any loss or damage come to light after the Clients and their guests have departed, Estate Escapes reserve the right to charge the Client’s credit/debit card and/or to send an invoice for the amount required to make good or remedy any such damage.

Clients property

Estate Escapes does not accept responsibility for any of the Clients belongings left at the Hotel. Every effort shall be made to store and log any lost property for up to 6 months following the guests’ departure, but any items unaccounted for are the owner’s responsibility.

Changes by the hotel

Due to circumstances beyond the control of the Hotel, it may be necessary to change or cancel your booking. Where the change is considered major, as decided by management, you will have the option to accept the change or receive a full refund of any monies paid. Estate Escapes is not responsible for any other costs, expenses or damages incurred by the Client as a result of the changes.

The Devonshire Arms Hotel

Estate Escapes will not be liable for failure to comply with any terms and conditions of this agreement to the extent such compliance is prevented, hindered or delayed by any cause beyond its control including but not limited to fire, storm, explosion, flood, act of God, action of any Government or Government Agency, shortage of goods, strike or lock-out, failure of supply of electricity, water or gas, gas leakage or water leakage.

Health and safety

All Clients running functions are responsible and must ensure full compliance with Estate Escape’s Health and Safety policy, a copy of which is available on request. We reserve the right to refuse connection of water, gas/electricity to the Client’s equipment if we consider it unsafe or a hazard.

Jurisdiction

The validity, construction and performance of these terms and conditions shall be governed by English Law and any disputes shall be subject to the exclusive jurisdiction of the English Courts.

Third parties

The parties agree that these terms and conditions are not enforceable by any third party under the contracts (Rights of Third Parties Act 1999).

Variation

No variation to these terms and conditions shall be effective unless it is in writing and signed by the parties (or their authorised representatives).

Entire agreement

These terms and conditions and function sheet constitute the entire understanding and agreement between the parties and supersedes any previous agreements, promises, assurances, warranties, representations and undertakings between Estate Escapes and the Client whether written or oral, relating to the function. Dog-friendly holidays and short breaks

Our dog friendly hotels are prepared to accommodate fully trained, well-mannered, healthy pets. All of our hotels and inns are dog friendly, however please note that we only permit resident dogs in The Garden Room Restaurant.

Your pet must be kept on a leash and accompanied by yourself, or held in arms, in all public areas of our hotels and inns, including outdoors.

Please do not leave your pet unattended. Should you require pet services and supplies, please contact reception prior to arrival.

Please contact reception at extension 0 to arrange for a convenient time for cleaning your room. For the safety and comfort of your pet, Housekeeping will enter your room only if your pet is not present or you are present and your pet is leashed.

You are responsible for cleaning up after your pet in the hotel, inn or in the neighbourhood.

Any disturbances must be curtailed to ensure other guests are not inconvenienced. We reserve the right to require immediate removal of any pet that displays inappropriate behaviour including, but not limited to, excessive barking, biting, evidence of disease. You will be responsible for all charges relating to the removal of your pet including transportation and kennel charges.

A £20 per dog per night fee is charged for your pet to stay at any of our dog friendly hotels and inns. However, as the pet owner and registered guest, you will also be responsible for any additional cost for deep-cleaning, repair and replacement of damaged facilities caused by your pet.

You further agree to indemnify and hold harmless Estate Escapes, its owners and its operators from all liability and damage suffered as a result of your pet.

Emotional support pets

We understand some pets and animals can be vital components of ongoing mental health treatment and support for hidden disabilities. Therefore we’re delighted to welcome emotional support animals who are registered with the charity ESA (Emotional Support Animals). Please just let us know at the time of your booking if you plan on bringing your animal, as it enables us to prepare and allocate your room accordingly.

Spa Etiquette 

  • For the benefit and peaceful enjoyment of the spa by all users, we request mobile phones and devices are turned to silent when in the Spa. Mobile devices and cameras may not be used in changing rooms under any circumstances. We request all members and guests respect people’s privacy.  
  • The Devonshire Arms Spa operates a strict non-smoking policy in accordance with UK law. Smoking (including the use of e-cigarettes) is not permitted within the Spa, poolside, its facilities, or immediate external areas. 
  • Swimwear must be always worn within The Spa. Robes are provided. 
  • Lockers are provided for use by members and guests during their visit to The Spa. Lockers may not be kept for personal use. Any property left overnight will be removed and kept in lost property for 30 days. 
  • The Devonshire Arms Spa accepts no liability, under any circumstances, for loss, damage, injury, or consequential loss to guests or their personal property. 

General Terms 

  • This agreement is between yourself – the member – and the Devonshire Arms. To become a member of the Spa, you must complete a Membership Application and Agreement. You will need to provide a photograph or allow a photograph to be taken.  
  • The Spa reserves the right to amend treatment times on the day where operationally necessary. 
  • All stated treatment times include consultation, preparation, and the treatment itself. 
  • Jewellery may need to be removed for certain treatments. Guests are advised to leave valuables at home. 
  • Special offers and discounted products cannot be used in conjunction with any other promotion and are subject to availability. 
  • Children under the age of 16 are not permitted within the Spa. 
  • Pets are not permitted in or around the Spa or surrounding grounds. 
  • An optional 5% service charge will apply to all treatments, packages and food and beverages.  

Health & Safety 

  • All Spa visitors and their guests are required to follow the health and safety rules for all facilities. 
  • All Spa visitors who have booked treatments are required to complete a medical consultation and consent form upon arrival. 
  • Guests must disclose all relevant medical conditions, pregnancy, or contraindications accurately and in full, by contacting the Spa directly on (Tel Number)  
  • Guests with heart conditions, high blood pressure, or who are pregnant are strongly advised not to use heat-based facilities including the Sauna & Steam rooms. 
  • Failure to complete the medical questionnaire on arrival may result in treatment refusal. 
  • Where a treatment cannot proceed due to accurately disclosed medical information, a suitable alternative treatment or a full refund will be offered. 

 

Pregnancy Terms & Conditions 

  • Massage and body treatments are not available during the first trimester (1–12 weeks) of pregnancy. Pregnancy-safe facials may be offered. 
  • From 13 weeks onwards, a range of specialised pregnancy treatments is available. 
  • The Spa endeavours to maintain pool temperatures suitable for use during pregnancy; should this not be possible, guests will be informed promptly. 
  • Pregnant guests are strongly advised not to use heat or hydrotherapy facilities.  
  • Rasual treatments are not suitable during pregnancy. 
  • Pregnant guests will be advised of potential risks and will be required to complete a disclaimer form confirming informed consent. 
  • All staff will respect confidentiality; however, for safety reasons, guests are strongly encouraged to disclose pregnancy prior to arrival. 

Oncology Treatments 

  • Disclosure of any current or previous cancer diagnosis is required at the time of booking. 
  • Treatments may only be performed by an Amethyst Trust–trained therapist, subject to availability. 
  • Failure to disclose a diagnosis prior to booking may result in treatment cancellation without refund. 
  • The Spa offers a range of treatments suitable for guests with a cancer diagnosis; please contact the Spa team for guidance. 

Rescheduling Policy – Treatments 

  • Full payment is required at the time of booking for all treatments. 
  • Once purchased, tickets cannot be refunded or returned. 
  • Rescheduling requests made within 24 hours of the treatment time are non-refundable. Rescheduled requests incur a £10 administration fee and are subject to availability. 
  • Non-attendance will result in the full treatment fee being retained. No refund will be issued. 
  • Late arrival may result in a reduced treatment duration with no price adjustment. 

Spa Days & Packages 

  • Amendments to treatments within a Spa Day or Package must be requested at least 24 hours prior to the scheduled treatment time and are subject to availability. 
  • Amendments or rescheduling of Spa Days or Packages within 7 days of arrival will incur a £10 administration fee. 
  • All third-party bookings (including but not limited to Travelzoo, Spa Seekers, and Spa Breaks) are subject to the payment and cancellation terms of the third-party provider, which may differ from those of The Devonshire Arms Spa. 
  • Arrival times and treatment schedules are fixed according to the purchased package and cannot be amended. 
  • While every effort is made to schedule treatments simultaneously for multiple guests, this cannot be guaranteed. 
  • Guests must notify the Spa of any dietary requirements, pregnancy, or medical conditions prior to arrival, please contact the Spa Team on 01756 718142. 

Gift Voucher Refunds 

  • Under the Consumer Contracts (Amendment) Regulations 2015, voucher purchases may be cancelled within 14 calendar days of receiving the confirmation email, provided the voucher has not been redeemed. 
  • Cancellation requests must be submitted in writing or via email within the cancellation period. 
  • Refunds will be processed within 14 calendar days using the original method of payment. No cash refunds are available. 
  • If a voucher is redeemed or the cancellation period expires, the right to cancellation and refund is waived. 
  • Refunds will be processed once only. The Spa is not responsible for recovering funds where payment details have changed. 

Membership Terms & Cancellations 

  • Annual Payment Membership – For annual payment memberships, the contract term is 12 months. Members pay for 10 months and receive 12 months’ full access. All renewals are subject to the terms and conditions of the membership contract. Memberships purchased online will renew automatically, provided a valid payment card remains registered on the account. 
  • Monthly direct pay Memberships – the initial contract term will be 3 months. Thereafter, Memberships will continue indefinitely on a monthly basis at the prevailing rate, in accordance with the terms and conditions of this contract.  
  • Cancelling your contract – After completion of the initial contract term, monthly direct pay Memberships may be terminated by you giving a minimum of 30 days’ notice in writing direct to the Spa Manager or by emailing spabookings@thedevonshirearms.co.uk 
  • Your cancellation will be acknowledged by an email or letter from the Spa advising of your final payment and date your membership expires. Telephone or verbal cancellations will not be accepted. 
  • No refunds or credits will be issued for any part of a paid billing period. 
  • If payment fails or a card becomes invalid, Spa access will be immediately suspended, and the membership card will be void until outstanding payments are settled. 
  • A 14-day cooling-off period applies to new memberships under the Consumer Contracts (Amendment) Regulations 2015, during which a full refund will be issued to the original payment method. 
  • We may cancel memberships of any Member in the event they commit a breach of the membership agreement. Any refunds owed will be at the discretion of the management. 
  • Membership Suspension Membership may only be suspended by pregnancy, redundancy or physical incapacity through long-term injury or illness, if supported by official evidence. The request to suspend Membership must be received in writing. A request for Membership suspension will only apply to Members on an annual Membership. Membership can be suspended for a maximum of 3 months.
